The Government issued Decree No. 36/2019 / ND-CP detailing, amending and supplementing a number of articles of the Sport and Physical training law

On April 29, 2019, the Prime Minister Nguyen Xuan Phuc signed the Decree 36/2019 / ND-CP detailing a number of articles of the Law amending and supplementing a number of articles of the Sport and Physical training laws. In particular, specific regulations on regimes and policies to implement the rights of athletes and elite sports coaches; conditions for conducting businesses related to sports activities of professional sports clubs as well as for enterprises. This Decree takes effect from June 14, 2019.

Many incentives for elite sports athletes are issued

With regard to health care and injury treatment, the Decree specifies the periodic health check for athletes at least twice a year. Elite sports athletes are provided with health care, rehabilitation and treatment of injuries at domestic medical facilities. In special cases, the Minister of Culture, Sports and Tourism allowelite sports athletes (designated) to trainin national sports teams preparing to attend and potentially win medals at the Asian Games and the Olympic Games;athletes attending the Paralympic Games are entitled to injury treatment abroad.

Regarding the specific nutrition regimen, elite sport athletes and coaches are entitled to a special diet to ensure adequate nutrition is needed for the ability to practice, including: daily meals and dietary supplements. The time to enjoy a special diet is calculated during the time of training and competition for athletes and coaches. Elite sports coaches and athletes summoned to national sports teams for the preparation for the Southeast Asian Games (SEA Games), the Asian Games and the Olympic Gameswill receivegreater nutrition regimenmaximum 50% of the prescribed level for 90 days or less.

Elite sports athletes and coaches summoned to join national sports teams and having potential in winning a gold medal at the Asian Games, a gold medal at the Youth Olympic Games, being qualified for the Olympic Games and Paralympic Games are entitled to a greaternutrition regimen not exceeding 100% of the prescribed level, as well as nutritional supplements according to the specific characteristics of each sport (according to the regulations of the Minister of Culture, Sports and Tourism).

One of the issues that deserves attention is the issue of job settlement for athletes after their retirement is also specified in this Decree, whereby the athletes of the national sports team, the sports team of an industry,province and city directly under the admistration of the central government, when they retireas athletes, they are entitled to receive vocational training needs and support, they shall be supported with vocational training according to the provisions of Decree No. 61/2015 / ND-CP dated July 9, 2015 which regulates employment support policies and the National Employment Fund. 

Athletes who win medals at the Olympic Games, Asian Games and SEA Games are given priority: Admission to work at public sports facilities that is appropriate with the applied position; be awarded extra points in the recruitment processin sports facilities after having sufficient professional qualifications and capabilities suitable to the requirements of the job; during the apprenticeship period, they shall enjoy 100% of the salary and allowances of professional titles corresponding to the job positions.

The athletes who are studying in educational institutions, vocational education institutions are summoned to the national sports team, sports teams of the provinces and cities directly under the central government, the organisation requiring the athletes shall pay their tuition fees according to the provisions of this law.

Athletes and coaches from national sport teams who have graduated from high school andhave been confirmed by the Ministry of Culture, Sports and Tourism of havingparticipated in the Olympic Games, the World Championship, the World Cup,the Asian Games, the Asian Championship, the Asian Cup, the SEA Games, the Southeast Asian Championship and the Southeast Asian Cup are given priority: Direct admission to the sports or physical education fieldsin universities and colleges; being selected to attend training courses for coaches to improve professional skills, being given priority to consider exemption and reduction of tuition fees.

Salaryfor training and competition, social insurance, health insurance; unemployment insurance; insurance for labor accidents and occupational diseases; insurance for trainings, overseas competitions and bonuses based on the performance of elite sport coaches and athletes during the period of training and competition are set out in the provisions of the Decree Decree 152/2018 / ND-CP dated November 7, 2018.

Business conditions for sports activities of professional sports clubs

In addition to regulations on regimes and policies to implement the right and duties of elite sport athletes and coaches, Decree 36/2019 / ND-CP also stipulates conditions for operating business for professional sports clubs. Accordingly, the professional coaches must meet one of the following conditions: Have a graduation certificate of sport universities, complete a professional coach training program from the National Sports Federation, have a professional coach issued by the European or world sports federation of professional sports or have a professional foreign coach recognized by a continental or world sports federation.

Professional athletes must meet the following conditions: have an employment contract with a professional sports club; be recognised as a professional athlete by a national sport federation. In casean athlete is a foreigner, he/she must have a professional sports transfer certificate to Vietnam, an international transfer certificate and a working permit in accordance with the labour laws.

The Decree also specifies regulations on professional facilities, equipment for training and competition of sports, to ensure national technical standards, Vietnamese or international standards and conform to regulations of international professional sports organizations.
